Welcome to AdOnAir, operated by M Genio (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of the AdOnAir mobile application (the “App”) and any related services provided by us. By accessing or using our App, you agree to be bound by these Terms.

1. Eligibility

The App is available to all users who are at least 18 years old or have the consent of a parent or guardian and agree to comply with these Terms. By using the App, you confirm that your use does not violate any applicable laws or regulations.

2. Accounts Users may create accounts on the App. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. You must notify us immediately of any unauthorized use of your account.

3. User-Generated Content You may create and upload content, such as text, images and video (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute your content within the App. You represent that you own or have the right to upload such content and that it does not infringe any third-party rights.

4. Purchases and Subscriptions

• In-App Purchases: The App offers goods, items, and services for one-time purchases. All sales are final unless required by law.
• Subscriptions: We offer subscription plans, some of which may include a free trial. You may cancel subscriptions before the trial period ends to avoid charges. Subscription fees are billed on a recurring basis unless canceled in accordance with the subscription terms.

5. Promotions, Contests, and Sweepstakes We may offer promotions, contests, or sweepstakes. Each promotion will have its own specific terms, which will be made available to participants.

6. Intellectual Property All content, designs, trademarks, and other intellectual property provided by us within the App are our exclusive property. You may not use, reproduce, or distribute this content without our written consent.

7. Feedback and Suggestions Any feedback, suggestions, or ideas you submit to us may be used without compensation or credit. By providing such feedback, you grant us the right to implement and utilize it as we see fit.

8. Prohibited Activities You agree not to:

• Violate any applicable laws or regulations.
• Upload content that is offensive, harmful, or infringes on others’ rights.
• Attempt to interfere with the App’s security or functionality.

9. Disclaimer of Warranties The App is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, or available at all times.

10. Limitation of Liability To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.

11. Termination We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App’s operation. Upon termination, your right to use the App will cease immediately.

12. Dispute Resolution Any disputes arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Michigan, and the decision of the arbitrator shall be final and binding.

13. Severability If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

14. Governing Law These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict of law principles.

15. Changes to These Terms We reserve the right to update these Terms at any time. Changes will be effective upon posting. Your continued use of the App constitutes acceptance of the updated Terms.
